Débats officiels secrets et liberté de l​’information: le nouvel article 293 du Code pénal serait-il l’œuf de Colomb?

I. Introduction

Le 1er mars 20182, après des années de débats dans la doctrine3 et devant le Parlement4, la nouvelle teneur de l’art. 293 CP5 est entrée en vigueur. La novelle s’efforce de prendre en compte l’importance cardinale de la liberté d’expression pour limiter l’interdiction de publier des débats officiels secrets et est aujourd’hui libellée en ces termes:
